SHC issues notice to tax authorities on petition filed by Lovenzo Industries

KARACHI: The Sindh High Court (SHC) issued notices to the tax authorities and deputy attorney general of Pakistan on a constitutional petition filed by M/s Lovenzo Industries against fixation of rate $2.00/kg instead of $1.75/kg on baby diapers.

While the hearing of the petition, a two-member bench, comprising Justice Irfan Sadat Khan and Justice Muhammad Humayun Khan, also directed the respondents to file their respective comments on the next date of hearing. The court adjourned the hearing for November 28, 2016.

Earlier, counsel for the petitioner stated that petitioner is engaged in the manufacturing of sanitary items including baby diapers which are manufactured at the facility of the petitioner in Pakistan and for the purpose of such manufacture, the petitioner procures/ purchase various raw material from the local market as well as international for source such as China.

According to the petitioner, respondents issued impugn order pursuant to revision petitions filed by the persons/ entities against the valuation ruling no 926 of 2016 dated 08/09/2016 and fixed the rate of US$ 2.00/kg illegally, he argued that actual price paid/ payable for the impugn item by the petitioner at or About at the rate of US$ 1.75/kg.

Citing Chairman Federal Board of Revenue (FBR), Director General Directorate of General of Customs Valuation and Collector of Customs Model Customs Collectorate Appraisement East as respondents, petitioner pleaded the court may declare act of the respondents is illegal, mala fide and arbitrary, petitioner also pleaded the court may set aside impugn order of the respondents.
