KARACHI: The Sindh high Court issued notices to the customs officials and deputy attorney general of Pakistan and directed them to make sure filing their respective para wise comments on a constitutional petition filed by M/s Al-Mashood Oil & Ghee Industries Private Limited against refusal of releasing its imported consignment.
On 4 September 2021, during the hearing, counsel for the petitioner argued that petitioner is a producer of oil, ghee and allied products, which is primarily sold in FATA, PATA according with law.
He further argued that petitioner is seriously aggrieved by the illegal actions of the Collector of Customs Port Muhammad Bin Qasim, who has refused to allow the release of consignment of raw material of the petitioner, further it has also not decided the request pending before it to declare the area of Miran Shah as an area where private bonded warehouse may be located/ licensed.
Citing Chairman FBR, Secretary Ministry of Finance, Chief Collector of Customs Collectorate Port Muhammad Bin Qasim, Collector of Customs Port Muhammad Bin Qasim and Customs Collectorate Peshawar as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.
Counsel further pleaded the court may direct them to decide petitioner pending request and also direct them to release the consignment of the petitioner immediately and restrain them from taking any adverse action against the petitioner till final order in this petition.
