KARACHI: A two-member of the Sindh High Court (SHC) issued pre-admission notice to customs officials as well as Deputy attorney general of Pakistan on a constitutional petitions filed by Amjad Ali Shah, Muhammad Uzair, Sad Furqan Shah, Kahir Zada and other seeking their imported vehicles seized by customs officials due to smuggling allegations.
On 9 May 2022, during the hearing, M Faisal Qasmi and other advocates appeared before the court representing petitioners and moved urgent application and argued that their petitions are on urgent basis, therefore, court may grant urgency and may be heard during the course of day.
After the hearing, court granted urgency and passed directions that subject to maintainability of these petitions, let pre admission notice be issued to the respondents as well as DAG for next date of hearing.
Earlier, counsels stated the court that petitioners are importers and have imported used car and other vehicles under personal baggage scheme, however, after reaching vehicles on port, customs officials seized the same and now these vehicles is being auctioned without following legal procedure.
Citing Chairman Federal Board of Revenue, Collector of Customs Appraisement Port Muhammad Bin Qasim as respondents, petitioners pleaded the court may declared act of the respondents is illegal, mala fide and arbitrary.
Counsel for the petitioners further pleaded the court to direct them not to auction these imported vehicles till final order in these petitions.
