KARACHI: The Sindh High Court (SHC) has issued notice to importer Danish Naseem on an appeal filed by Additional Collector of Customs Model Customs Collectorate of Appraisement-East against impugned order of the appellate tribunal in alleged mis-declaration case.
A two-member bench, comprising Justice Irfan Sadat Khan and Justice Muhammad Humayun Khan, was hearing the appeal.
Earlier, counsel for the applicant stated that importer Danish Naseem had imported a consignment declared as “raw material for mosquito mat made of wood pulp” and claimed its release at 0% customs duty by paying others taxes in terms of section 79 (1) of the customs act, 1969.
According to applicant, during the examination goods were found as “mats in the form of while cut to size table with the words” king mat” which in correctly at the rate of 25% customs duty instead of 0% customs duty”.
Counsel further argued that being the aggrieved, said importer filed an appeal before the appellant tribunal which was allowed without merit.
Citing Danish Naseem as respondent, applicant pleaded the court may set aside impugn order of the tribunal dated July 10, 2014 and restore its order.
