SHC issues notices to M/s Tahir Food Products & others in betel nuts smuggling case

KARACHI: A two-member bench of the Sindh High Court (SHC) issued notices to M/s Tahir Food Products and others on a constitutional petition filed by Director General Intelligence & Investigation-FBR against releasing order for 72,000 kg betel nuts by a single bench of the SHC.

On 8 March 2022, during the hearing, counsel for the petitioner informed the court that on information, customs officials found 1200 bags of foreign origin betel nuts 72,000 kg from godown/ premises of M/s Chemitax, when no import documents were produced by the possession holder to discharge Bardon of prof of lawful process.

He further informed the court that after the all-legal formalities, customs officials seized above mentioned goods, however, above mentioned importer approached a single bench for release order of the same and a single bench, directed customs officials to release the betel nuts consignment.

He submits that a single bench passed order without consideration of facts, therefore, set aside impugned order.

Citing M/s Tahir Food Products, Secretary Revenue Division, Chief Collector of Customs Appraisement West, Collector of Customs Appraisement South, Advisor & Director General Department of Plant Protection as respondents, petitioners pleaded the court to set aside impugned order passed by a single bench of the Sindh High Court.
