KARACHI: A two-member bench of the Sindh High Court (SHC) issued notices to Manzoor Khan, proprietor of M/s The Awan Petroleum Services and Muhjeeb ur Rahman for next date of hearing on a special customs reference application filed by Director Intelligence & Investigation-Customs challenging impugned judgment passed by customs appellant tribunal.
On 31 March 2022, during the hearing, counsel for the applicant made his arguments and after the arguments, court observed in its order that “through this special customs reference application certain questions of law have been raised, let in the first instance notice be issued to the respondents no 1 & 2for the date to be fixed by the office”.
Earlier, counsel for the applicant challenged impugned judgment and argued that on a credible information, anti-smuggling organization (ASO) officials intercepted a oil tanker bearing registration number TUB 164 at Super Highway Karachi loaded 30,000 liters of HSD Oil.
He argued that during the checking, driver was asked to produce lawful documents, however, driver was failed to produce any lawful documents, therefore, after fulfilment of the all the legal formalities, customs officials seized the same and lodged first information report.
Counsel added that respondents approached the customs appellant tribunal which allowed the appeal and had directed to customs officials to release the seized vehicle along with goods.
Citing above mentioned parties as respondents, applicant pleaded the court may sed aside impugned judgment passed by customs appellant tribunal.
