SHC postpones hearing of petition filed by M/s Chokshi Shipping till Jan 26

KARACHI: The Sindh High Court (SHC) has issued notices to the tax authorities and deputy attorney general on a constitutional petition filed by M/s Chokshi Shipping against fixation of its consignment of non-woven fabrics at the rate of $04.53/kg instead of declared value at the rate of $1.1137/kg.

A two-member bench, headed by Justice Munib Akhtar heard the petition and directing them to file their respective comments for January 26, 2017.

Earlier, counsel for the petitioner stated that it has imported a consignment of non-woven fabrics from UAE and filed goods declaration at the rate of $1.1137/kg according with the law.

According to the petitioner, without following the mandatory provisions of the act, the director general of valuation issued a fresh valuation ruling at the wishes and whims of the respondents well as other beneficiaries/ whereby the value of the goods in question has been fixed at $04.53/kg instead of the declared value at $1.1137/kg and are being illegally applied on the petitioner’s imported consignment of non-woven fabrics from UAE.

Making Federal Board of Revenue Chairman, the Collector of Customs Collectorate, the Collector of Customs (Imports) and the Director General of Valuation as respondents, the importer pleaded the court to declare that act of the respondents as illegal, mala fide and arbitrary.

The petitioner also pleaded the SHC to restrain the department from taking any coercive action against the importer and direct them to release the consignment according to the declared valuation.
