SHC rejects petition filed by M/s A.B International Agency & others

KARACHI: A two-member bench of The Sindh High Court (SHC) dismissed a constitutional petition filed by M/s A.B International Agency, M/s Prime Chan, M/s Khalid Corporation, M/s Abid Enterprises, M/s Golden Textile, M/s Bilal Brothers Industry, M/s Gulf Enterprises, M/s Zakria Enterprises and others.

On 25 January 2022, Imran Iqbal Khan advocate for petitioner, Aamir Rana along with Tariq Ahmed Principal Appraiser, Bilal Bhatti for Customs Appraisement West and Kafeel Ahmed Abbasi, deputy attorney general of Pakistan appeared before the bench.

Counsel for the petitioner argued that under instruction of his clients does not press instant petitions, after his submission, court dismissed petition as not pressed along with pending applications.

Earlier, counsel for the petitioners added that petitioners are seriously aggrieved and highly prejudiced by the actions of the respondents, whereby, the customs officials have denied to implement of order of the customs appellant tribunal including the petitioner customs appeal no 1245/2019 and not allowing provisional release of the consignments despite clear court orders passed by the customs appellant tribunal on Dec 12, 2019.

Citing Chairman Federal Board of Revenue, Collector of Customs Appraisement East, Collector of Customs Appraisement West, Collector of Customs Port Muhammad Bin Qasim as respondents, petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary.

Petitioners further pleaded the court to direct them to release their imported consignments and restrain them from taking any adverse action against the petitioners till final judgment in this constitutional petition.

A two-member bench, headed by Justice Irfan Sadat Khan heard the matter and dismissed as not pressed.
