SHC releases imported vehicle after securing differential amount

KARACHI: A two-member bench of the Sindh High Court (SHC) directed customs officials to release petitioner’s imported vehicle on provisional release after securing differential amount on the shape of bank guarantee/ pay order from petitioner Sumair.

On 24 January 2022, a two-member bench, headed by Justice Irfan Sadat Khan heard the matter.

During the hearing, Dil Khurram Shaheen advocate for the petitioner, Bilal Bhatti advocate for customs officials, Kafeel Ahmed Abbasi, deputy attorney general of Pakistan appeared before the bench.

After the hearing, court disposed of a petition with directions that “court disposed of this petition with directions that respondents to allow provisional release of petitioner’s imported vehicle Toyota Crown Car model 2008, however, petitioner will take undertaking before nazir of this court not to create any third party interest in the subject vehicle till further order r final decision in SCRA”.

Citing Sectary Finance, Director Intelligence & Investigation Federal Board of Revenue as respondents, petitioner pleaded the court to declare that petitioner imported above-mentioned vehicle according with law as well as direct them to release the same.

Counsel for the petitioner also pleaded the court may declare act of the respondents is illegal, mala fide and arbitrary and restrain them from taking any adverse action against the petitioner till final order in this petition.
