SHC restrains customs officials for lodging FIRs against M/s General Services and others

KARACHI: The Sindh High Court (SHC) restrained customs department against registration of FIRs, further coercive action, opportunity of being heard petitioners on a petition filed by M/s General Services and others allegedly involving in mis-declaration.

On 26 November 2019, a two-member bench released the order heard by a two-member bench, headed by Justice Aqeel Ahmed Abbasi.

Court mentioned in its order that “according to the petitioners, respondents have registered four first information reports (FIRs) against petitioners dated April 23, 2019, wherein petitioners have been shown as accused on the above allegation as bonded warehouse license has been issued in their names, petitioner obtained protective bail from learned single judge of this court.

He further submitted that interim pre-arrest bail has been granted to the petitioners, however, serious apprehension that petitioners will be involved in similar frivolous FIRs, which will cause serious injury and humiliation to the petitioners who have not committed any offence nor violated the terms of bonded warehouse license”.

After the hearing, court issued pre-admission notices to the customs officials and directed respondents to “conduct themselves strictly in accordance with law and not to create harassment to the petitioners in respect of aforesaid FIRs, and unless there is some concrete material available with the respondents against the petitioners requiring any further coercive action against them, including registration of FIRs, opportunity of being heard shall be provided to the petitioners. However, petitioners shall not be arrested without permission of the court till next date of hearing”.
