SHC seeks comments on petition filed by M/s Khurram and Sons

KARACHI: The Sindh High Court (SHC) issued notices to the customs’ high officials and deputy attorney general on a constitutional petition filed by M/s Khurram and Sons against enhancement of valuation of imported styrene butadiene rubber (SBR), synthetic rubber NBR6240 unit value $1.65/kg to $2.50/kg instead of $1.25 and $1.28 per kg under the garb of valuation ruling no 1091/2017 dated 18/03/2017.

On 10 December 2019, a two-member bench, headed by Justice Aqeel Ahmed Abbasi was hearing the matter.

During the hearing, counsel for the petitioner argued that petitioner has imported consignments comprising styrene butadiene rubber (SBR), synthetic rubber NBR6240 unit value of $1.25 and $1.28 per kg and after filing goods declaration requested to the customs officials to release its consignments. However, respondents insisting to assess value $1.65/kg to $2.50/kg.

He further submitted that petitioner further requested them to accept the declared value under section 25(1) of the customs act, 1969 and finalize the assessment accordingly, however, they without confronting the declared transaction value has denied to accept the same and proposed to assess the duty and taxes on the basis of impugned valuation ruling no 1091/2017 dated 18/03/2017.

Citing chairman FBR, Collector of Customs Appraisement East, the director, Directorate General of Customs Valuation as respondents, petitioner pleaded the court to direct the respondents/ their officers to allow provisional release in the present and future consignments shipped and/ or to be shipped in terms of parameters laid down by this court.

He further pleaded the court may declare that non allowing provisional release of consignment is disregard/ disobeying to the orders of this court.
