KARACHI: The Sindh High Court 9(SHC) directed customs department and others to file their respective para wise comments on a constitutional petition filed by M/s Red Bull Pakistan challenging imposition of federal excise duty on imported aerated water.
On 6 December 2021, during the hearing, Muhammad Hussain Awan advocate for Customs Jinnah International Airport Karachi, Ahmed Memon advocate for collector of customs Port Muhammad Bin Qasim and collector of customs model customs collectorate appraisement east appeared before the court.
Earlier, counsel for the petitioner states that petitioner is aggrieved by the unlawful actions of the respondents whereby they are imposing federal excise duty on the valuation of the petitioner’s imported consignments of aerated water of the actual value of imports in violation of section 2 of the federal excise act, 2005.
He added the petitioner is also aggrieved by clarification issued by the federal board of revenue through its letter dated 23 Dec 2020.
Citing Secretary Revenue Division, Chairman Federal Board of Revenue, Collector of Customs Jinnah International Airport Karachi, Collector of Customs Port Muhammad Bin Qasim and Collector of Customs Model Customs Collectorate Appraisement East as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.
He also pleaded the court to set aside impugned demand notice and restrain them from taking any adverse action against the petitioner till final order in this petition.
