SHC seeks compliance report from customs officials on petitions filed by M/s Junaid Enterprises

KARACHI: A two-member bench granted urgent application and called compliance report from customs department on constitutional petitions filed by Khalid Mehmood for M/s Junaid Enterprises and other.

On 23 November 2021, a two-member bench, comprising Justice Shafi Muhammad Siddiqui and Justice Agha Faisal heard the matter.

During the hearing, Rana Sakhawat Ali advocate for petitioner, Muhammad Rashid advocate for customs department, Kafeel Ahmed Abbasi deputy attorney general of Pakistan, Hussain Bohra assistant attorney general for Pakistan appeared before the court.

Counsel for M/s Junaid Enterprises argues that his matter is a very important and urgent basis, therefore, the court may hear his petition as soon as possible and grant urgency. After the hearing, the court granted an urgent application and directed customs officials to submit a compliance report for the next date of hearing.

Counsel for petitioner added that Khalid Mehmood for M/s Junaid Enterprises imported one unit used Toyota Land Lousier Jeep 2016 and paid duty and taxes below 70%, however, respondents claimed mis-declaration and vehicle was seized without lawful grounds.

Citing Secretary Revenue Division, Collector of Customs Appraisement East and others, petitioners pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.

They also pleaded the court to direct them to release their imported vehicles and restrain them from taking any adverse action against the petitioners till final order in these petitions.
