SHC seeks customs reply in M/S Care Impex’s tax evasion case

KARACHI: The Sindh High Court (SHC) on Thursday issued notices to the Model Customs Collectorate Appraisement-East collector and the Customs Adjudication deputy collector while hearing an application of M/S Care Impex against the charges of taxes evasion on imported consignment.

The SHC division bench, comprising Justice Munib Akhter and Justice Abdul Malik Gaddi, directed the respondents to make sure filling their comments on next hearing.

Earlier, the counsel of the applicant stated that M/S Care Impex imported a consignment comprising 49.94 metric tonne of “steel wire rod at the rate of $354.20 per MT from China valuing at $1,748,180 against telephonic transfer. The documents were filed for clearance and upfront leviable duty and taxes were deposited on the declared value in the bank amounting to Rs 468,988.

According to the applicant, instead of allowing clearance on the basis of declaration, authorities concerned conducted the examination and allegation was made that goods are steel wire in coils instead of steel wire rod which chargeable to customs duty 20 percent.

The applicant said that adjudication deputy collector issued a show cause notice stating that applicant was declared liable pay short levied amount to the tune of Rs 4.128 million and value of the offending goods come to Rs 1.146 million on the basis of data of identical.

The counsel added that the applicant filed an appeal before Customs Appellate Tribunal that was rejected. He pleaded court to set aside show cause notice as well as order of the Customs Appellate Tribunal.
