SHC seeks final arguments on petition filed by M/s Haji Ehsanullah

KARACHI: The Sindh High Court (SHC) directed customs department and deputy attorney general to conclude final arguments on a constitutional petition filed by M/s Haji Ehsanullah son of Muhibullah proprietor of M/S Ehsanullah & Company seeking release order of its imported old/ used Hino/Nissan Transit Concrete Mixer Lorries. A two-member bench, headed by Justice Munib Akhtar heard the petition.

Earlier, counsel for the petitioner stated that it imported old/ used Hino/Nissan Transit Concrete Mixer Lorries and filed Goods Declaration (GDs) as per law for clearance, which were seized by the customs department and allegation were fixed by the customs officials that petitioner violated the import policy and said vehicles are not allowed for import under import policy.

He submitted that petitioner imported these vehicles as per law and other importers are importing the same, therefore, seizing the same is illegal, mala fide and unlawful authority.

Citing Sectary Ministry of Finance, Chairman Federal Board of Revenue, Customs Appellate Tribunal, Collector of Customs Adjudication Hyderabad as respondents, petitioner pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary.

He also pleaded the court to direct customs officials to release its vehicles as per law and no action shall be taken against the petitioner till final order in this case.
