SHC seeks remarks from tax authorities on petition filed by M/s Idrees Steel Co, Sama Trade

KARACHI: Sindh High Court (SHC) has issued notices to secretary revenue division, Chairman FBR, Customs Collectorate East and others directing them to file their respective comments on an application filed by M/s Idress Steel Co and Sama Trade against regulatory duty.

A two-member bench comprising Justice Munib Akhter and Justice Abdul Malik Gaddi, heard the application.

Earlier, the petitioners’ counsel stated that petitioners imported a consignment of prime hot rolled alloy steel deformed bars from China on 26th January 2016 and paid applicable duties and taxes as payable on 21 March 2016.

According to the counsel, when the petitioners reached the port, it was informed that the officers of the respondents had called good declarations and the authorities were of the view that the consignments were assessable to duties. The respondent was of the view that the consignment had arrived on 24th March 2016 when a regulatory duty @ 30% had been imposed as per government vide SRO 236 (1)/2016. The counsel argued that the imposition of regulatory duty was unjust and unfair.

The petitioners prayed to the SHC to set aside impugned SRO over regulatory duty.
