SHC seeks reply con petition filed by M/s Unitech Industry Services

KARACHI: The Sindh High Court (SHC) directed customs officials and deputy attorney general of Pakistan to file their respective para wise comments on a constitutional petition filed by M/s Unitech Industry Services seeking release order of imported smart watches Bluetooth, earphones, hand frees, earphones covers and other related goods

On January 31 2022, a two-member bench, headed by Justice Irfan Sadat Khan heard the matter.

During the hearing, Rana Sakhawat advocate for petitioner, Kafeel Ahmed Abbasi, deputy attorney general of Pakistan appeared before the court.

During the hearing, counsel for the petitioner argued that petitioner imported smart watches Bluetooth, earphones, hand frees, earphones covers and other related goods and filed a goods declaration according to law.

He added the despite goods declaration, customs officials assessed on very high value undisputed items are US$ 0.25/item, US$ 0.05/item, US$ 1.0/item and same are assessed on US$ 1.25, US$ 1.0, US$ O.10/item and US$ 1.0/item respectively.

Citing Chairman Federal Board of Revenue, Collector of Customs Jinnah International Airport as respondents, petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary.

He also pleaded the court to direct them to release petitioner’s imported goods and restrain them from taking any adverse action against the petitioner till final judgment in this case.
