KARACHI: The Sindh High Court (SHC) has suspended the impugned show cause notice for recovery of income support levy @ 0.5 percent on the value of net movable assets/ wealth.
The court took the decision on a constitutional petition filed by Muhammad Usman Abdul Sattar against a show cause notice for recovery of income support levy @ 0.5 percent on the value of net movable assets/ wealth. During the hearing of the petition, a two-member bench comprising Justice Munib Akhtar and Justice Muhammad Humayun Khan also issued notices to the tax authorities and deputy attorney general, directing them to file their respective comments on the next date of hearing.
Earlier, counsel for the petitioner stated that the petitioner is paying all liabilities regularly, therefore, demand of the income support levy is illegal, without lawful authority and of no legal effect.
Citing Secretary Ministry of Law, Secretary Revenue Division, the Deputy Commissioner Inland Revenue DCIR Unit-1, Zone-V Corporate RTO and the Commissioner Inland Revenue Zone-V as respondents, he pleaded the court may declare that act of the respondents as illegal, mala fide and arbitrary. The counsel further pleaded the court may suspend the impugned show cause notice.
