SHC to hear petition filed by M/s Abbasi Trading Company on September 8

KARACHI: The Sindh High Court (SHC) has granted urgency and fixed September 8, 2016 as the date of hearing of a constitutional petition filed by M/s Abbasi Trading Company against the valuation of consignment of PVC hollow wall panels at the rate of $1.20 per kg instead of $0.90 per kg.

A two-member bench, comprising Justice Munib Akhter and Justice Anwar Hussain, was hearing the petition. During the hearing, counsel for the petitioner filed an application and requested the court for urgent hearing of the case, therefore, the court fixed the hearing for September 8,2016.

Earlier, the petitioner’s counsel stated the petitioner had imported PVC hollow wall panels from China and filed goods declaration for clearance at the rate of $0.708 per kg; however, the Model Customs Collectorate-East refused to declare CIF.

According to the petitioner, all others importers’ consignments were assessed at the rate of $0.90 per kg as per the value advice issued by the director valuation on July 7, 2015. He argued that state action should ensure fairness and equality of treatment. He added that when other importers of the same item were assessed at $ 0.90 per kg, why the consignment of the same product has been assessed at the rate of $1.20 per kg.

Citing Chairman Federal Board of Revenue ( FBR ), Director of Customs Valuation, Collectorate of Customs Model Customs Collectorate, Appraisment-East as respondents, Petitioner pleaded the SHC may declare that impugned value advise dated Aug 31, 2016, is illegal and is not total discharged and violation of Section 25 of the Customs Act, 1969.
