KARACHI: The Sindh High Court (SHC) has fixed November 24, 2016 as a date of hearing of a constitutional petition filed by M/s. ORO Industries challenging the impugned Valuation Ruling No 860 which enhanced the valuation of black lead pencils with eraser tip HB and etc.
A two-member bench, comprising Justice Irfan Saadat Khan and Justice Muhammad Humayun Khan was hearing the constitutional petition. During the hearing, counsel for the petitioner filed an application for urgent hearing.
Petitioner stated that petitioner imported the consignment of black lead pencils with eraser tip HB in bulk packing of 20 gross/ carton, item no 511 and black lead pencil with eraser tip HB, item no 512, in box packing of 12 pieces, 12 box/shrink pack of 24 gross carton from China and filed goods declarations (GDs) at the rate of $3.80/gross C& F and item no 512 at the rate of $ 3.94/gross C&F Karachi.
According to the petitioner, however, respondents issued impugn valuation ruling no 868 dated 09/06/2016 and fixed valuation at the rate of $ 13.50 kilograms for mostly European origin and $ 11.50kg for other origin illegally, mala fide and arbitrary.
Citing Directorate General of Custom Valuation, Customs Collectorate of Appraisement and chairman Federal Board of Revenue as respondents, petitioner pleaded the court may declare that act of the respondents as illegal and direct the respondents to release the consignment on deposit the postdated cheque of the differential amount before the nazir of this court.
