Smart Zone files appeal in Appellate Tribunal against collector’s decision

ISLAMABAD: M/S Smart Zone company Chief Executive Officer Shakir Ullah Jan and two Directors Asghar Khan and Latif Khan has filed appeal before the Customs Appellate Tribunal against decision of Customs Collector Adjudication, Islamabad.

According to official sources the penalty of Rs.6 billion imposed on them. According to the available documents of appeal, M/S Smart Zone Ceo and directors pleaded before the Tribunal that the imposition of penalty is illegal. The order has been passed in mechanical fashion without proper application of mind rationally, logically and judicially.

The show cause notice was issued on March 05, 2015 and as per the provision of the section 179 of the Customs Act 1969, the same was required to be decided within the stipulated time period. But despite of the aforesaid clear proposition of law, the collector Customs Adjudication has passed the order beyond the time limitation, which is indeed illegal.

They also plead that for the purpose of meaningful assistance to arrive at the logical and rational conclusion of the issue, we requested the collector adjudication office to provide copies of documentary evidence, which has been made basis to allege for committing the offence, but the said request was made a part of garbage of his office.
