KARACHI: The Supreme Court of Pakistan Karachi Registry has issued bailable warrant for two suspects, Afsar Khan and Jahangir Khan, for attempting to smuggle 146 kilograms narcotics.
A larger SC bench, comprising Chief Justice of Pakistan, Justice Anwar Zaheer Jamali, Justice Mushir Alam and Justice Faisal Arab heard the appeal filed by Anti-Narcotics Force (ANF), challenging the judgment of the Sindh High Court (SHC) that had converted the life imprisonment of accused into four and a half years.
During the hearing, the counsel for the ANF, Habib Ahmed submitted that one of accused namely Sarfraz was arrested, however, two accused namely Afsar Khan and Jahangir Khan had managed to escape. In the last hearing, the court had issued notices to the both accused however, they went to the Bajour Agency therefore the notices have not been served.
According to the prosecution, Anti Narcotics Force intercepted a bus on July 23, 2007 and during checking, 146 kilograms narcotics were recovered and accused persons were arrested after fulfilling all formalities.
After the trail, Anti Narcotics Court Karachi had awarded life imprisonment to all three accused, however in October 2010, the Sindh High Court ( SHC ) had set aside the impugned order of the trial court and converted the life imprisonment into four and a half years.
Anti Narcotics Force had challenged the judgment of the Sindh High Court and pleaded the Supreme Court of Pakistan to set aside impugned order of the SHC and restore the judgment of the trial court.
