Supreme Court reserves verdict in Ayyan Ali’s case

ISLAMABAD: A three-member bench of the Supreme Court headed by Justice Ijaz Afzal Khan, and Justice Sardar Tariq Masood and Justice Faisal Arab as members, conducted the hearing of a plea filed by customs adjudication against decision of the Sindh High Court in which the court had directed the removal of Ayyan Ali’s name from the Exit Control List (ECL).

Advocate Farhat Nawaz Lodhi appeared on behalf of the customs adjudication while advocate-on-record Rawalpindi MS Khattak, and Chaudhary Akhtar Ali were also present in the court. The attorney-general of Pakistan appeared on behalf of the Interior Ministry.

Sardar Latif Khosa and Khurram Latif Khosa defended Ayyan Ali in the court. During the hearing of the case, the counsel for the customs adjudication produced a copy of decision of the customs adjudication and said that after the decision of customs adjudication it was widely believed that if Ayyan Ali were allowed to travel abroad she will definitely not return. He further prayed to the court that a case against Ayyan Ali is still in progress in the court, therefore, her name must be placed in the ECL until final decision of the customs court.

The counsel for Ayyan Ali, Sardar Latif Khosa, said that the decision of the customs adjudication is totally one-sided and he rejects that decision. He said that according to the constitution of Pakistan there is no restriction on any citizen about his or her movement.

After hearing the arguments of both parties, the Supreme Court bench reserved its verdict in the case.
