Adjudication-II issues show case to M/s RTF Fertilizer for tax evasion

KARACHI: The Collectorate of Customs Adjudication-II has issued a show-cause notice against M/s RTF Fertilizer for allegedly causing a loss of Rs 2.1 million to the national exchequer by way of mis-declaration of classification, it is learnt.

Sources told Customs Today that during scrutiny of the import data it was revealed that M/s RTF fertilizer imported a consignment of different agriculture chemicals and cleared the same by mis-declaring the classification under Pakistan Custom Tariff 2978.5478 from Customs Port Qasim through their clearing agent namely M/s Bawera and Co. The company availed undue/ inadmissible benefit/ exemption of sales tax vide S. No. 42, whereas the imported goods are correctly classifiable under PCT 2975.4772.

It is pertinent to mention here that, M/s.RTF Fertilizer itself has imported identical/same import under correct PCT. Apart from it all other importers of different kind of fertilizers chemicals  have either been declared by the imports or assessed by the Collectorate under correct PCT.

Accordingly, an audit observation was issued to the said importer. The importer was requested to submit the reply soon. Instead, the importer requested for extension of seven days in submitting the reply.

However, the importer has failed to come up with any tangible evidence and explanation and is also unable to refute the charges leveled by the department.

It is necessary to mention here that Collectorate of Customs Adjudication-II has issued 18 show cause notices to defaulters companies in the month of September.
