SHC reopens petition filed by M/s Suriya Textile against sales tax

KARACHI: The Sindh High Court (SHC) on Monday (reopened) restored the petition filed by M/s Suriya Textile pertaining to the recovery of sales tax.

The SHC division bench, comprising Justice Munib Akhter and Justice Abdul Malik Gaddi, was hearing the petition.

During the hearing, the petitioner’s counsel requested the court to reopen its petition which was dismissed due to non-prosecution in the last hearing.

Earlier, the petitioner’s counsel stated that petitioner is manufacturer and exporter of textile made terry towels and manufactures in Karachi and exports it round the globe.

According to the petitioner, exports of the petitioner in last 3 year has been approximately Rs 663 millions and sum of approximately Rs 65 millions have been paid in terms of withholding tax. However respondents issued a show cause notice under sales tax, Act, 1990 on 20th may 2014 and demanded Rs. 1,923,226.

The counsel argued that against the demand notice, the petitioner filed an appeal before concerned authority but it was rejected.

Citing chairman FBR, deputy commissioner Inland Revenue, E & C Unit – 4, Regional Tax Office and others as respondents, the petitioner pleaded the SHC to set aside impugned order of the concerned authority.
