Pakistan Int’l Container challenges tax notice of Rs 139.5 million in SHC

KARACHI: The management of Pakistan International Container approached the Sindh High Court (SHC), challenging a recovery notice of disputed tax liability of around Rs 139.5 million issued by Deputy Commissioner Inland Revenue Unit-2, Enforcement and Collection, Zone – II, Large Taxpayer Unit.

The petitioner submitted that the officials of the respondents issued a general notice u/s 161 for monitoring of tax deducted as a withholding agent, without pointing out or specifying any specific expenditure claimed by the petitioner in the audited account. The petitioner added that the respondents demanded recovery of tax liability of Rs 139.5 million.

According to the petitioner, before the concerned authority it explained that deducted taxes on each and every taxable payments paid during the tax year 2010, but officials of the respondents had not agreed with the petitioner and asked to pay said amounts. Therefore, petitioner had filed an appeal before the concerned authority which is still pending.

Citing secretary Ministry of Law, chairman FBR, commissioner Inland Revenue zone – III Large Taxpayer Unit and others as respondents, the petitioner pleaded that SHC to declare that recovery of the disputed amounts as illegal and unjustified and stay it till decision of appeal by commissioner Inland Revenue (Appeals-II).
