Customs Appellate Tribunal accept appeals filed by M/s Ahmed Traders & M/s J&J Cargo

LAHORE: Customs Appellate Tribunal has accepted the appeal challenging seizure of copper tube case which was filed by the Collector of Customs Appraisement Lahore against M/s Ahmed Traders, M/s J&J Cargo and others on Friday.

Member Judicial bench-II Omer Arshed Hekeem examined the record and heard the arguments from the appellant and respondent side and deiced the case with remarks that appeal is accepted and appellant department is directed to recover redemption fine equaling 20 percent of the value of offending goods.

As per brief history of case, M/s Ahmed traders was imported copper tube in coils plain net weight 10318 kilograms falling under PCT heading 7411.1090 and copper tube inner grooved net weight 4550 kilograms falling under PCT heading 7411.1020.

On the physical examination of goods customs team found that importer mis-declared the physical description of goods in order to deprive the government from the legitimate revenue amounting to Rs42,82,336 and contravention the provision section 32 (1) of Customs Act 1969.

After the show cause notice, adjudication proceeding were culminated and passed the Order-in-Original that importer had not deliberately tried to hoodwink as has been alleged so the show cause notice is vacated.

Being aggrieved with order, appellant department challenged the order before the Customs Appellate Tribunal on the ground that order in original not according the definition of law, without consideration of facts and liable to set aside but the respondent denied all allegations. After hearing arguments from both sides, Customs Appellate Tribunal has accepted the appeal with order to recover duties.
