LAHORE: Customs Appellate Tribunal has dismissed the appeal in seized Indian Liquor case. The same appeal was filed by Muhammad Latif against collector of Customs (Appeal) and others.
According to brief history of case, information was received through the credible sources that a car coming toward Defense Bund Road to collect huge quantity of Indian Liquor. On the check post the car was stopped the driver were apprehended. During the interrogation, driver admitted the crime and case was registered in police station under section 156(1)(8)(92) of customs act 1969.
Show cause notice were issued and order in original passed with remarks that goods were seized out rightly. The order in original was challenged before the Collector of Customs (Appeals) who hear the party and decided the case with remarks that order in original is upheld and appeal is rejected.
Being aggrieved from the order, appellant filed the case before the Customs Appellate Tribunal with remarks that earlier both order passed without appreciation of law and the order in original is liable to set aside. On the other side, respondent denied all allegations. After hearing the arguments, member judicial Omer Arshed Hakeem has dismissed the same appeal.
