Customs Appellate Tribunal remands back appeal for fresh order within 45 days

LAHORE: Customs Appellate Tribunal on Friday has set aside the Order-in-Original (ONO) in allegedly misuse of DTRE in import of polyester fabric dyed plane PVC coated lining apart of 10222 pieces of textile jackets.

The appeal was filed by M/s White Land Industries Private Limited Sialkot against Customs Collectorate, Sambrial, Sialkot and others.

Muhammad Shabbir Gujjar, Judicial Member, heard the arguments from both parties and decided the case with direction to Additional Collector of Customs (Adjudication) to decide case within 45 days after hearing the arguments from both sides again.

According to the details of case, customs team during scrutiny of documents noticed that importer M/s M/s White Land Industries Private Limited was allegedly misuse of DTRE in import of polyester fabric dyed plane PVC coated lining apart of 10222 pieces of textile jackets.

After show-cause notice, adjudication proceeding were culminated and Order-in-Original was passed against the importer who aggrieved with the order and filed the appeal before the Customs Appellate Tribunal.

Appellant raise a point that order in original passed in mechanical fashion and without the consideration of law. The same order is liable to set aside.

On the other side, respondent department denied all allegations and produce proof on which the taxes and duties charged on the importer and also appeal for rejection of case.

After hearing arguments from appellant and respondent side, Customs Appellate Tribunal has set aside the order in original in appeal filed by the importer  M/s White Land Industries Private Limited Sialkot and directed the adjudication authority to pass a fresh speaking order.
