Customs Court allows proprietor of M/S SMD Sons to perform Umrah

KARACHI: The Customs Court allowed to return of passport to suspect namely Shaikh Muhammad Amin, proprietor of M/s SMD Sons, who was booked in mis-declaration case, to perform Umrah.

On December 8, 2018, counsel for suspect filed application and argued that the applicant intend to perform Umrah; therefore, application may be allowed.

Ashiq Anwar Rana, Special Prosecutor for the state, recorded his no objection for return of passport to the applicant/accused.

During hearing, the court passed order that “in view of above and considering the facts urged by the applicant, the application is allowed, two month passport is order to be returned to accused but on furnishing solvent surety in the sum of Rs100,000, the accused shall also execute the bond for return of passport within two months after the date of departure abroad.

Earlier, investigation officer had produced charge-sheet against Shaikh Muhammad Amin, proprietor of M/s SMD Sons, Abdul Samad son of Muhammad Haroon, proprietor of M/s Zafar Enterprises and Muhammad Shahid son of Ibrahim, proprietor of M/s Zafar Enterprises and informed the court that suspects were involved in mis-declaration of kerosene oil worth Rs239,684,276.

A case was registered for violating of import restriction as it was importable by approved oil marketing companies only. The accused people were charged in violation of provisions of Section 2(s), 16, 32(1), 79(1), 168 of the Customs Act, 1969, punishable under Section 156(1)(8)(14)(43)(81)(82)(89) and 157(2) ibid, read with Section 3(1)3 of the Import and Export Control Act, 1950 and import restriction vide S#2 of Appendix-B (Part-II) to IPO, 2016, further read with clause (a) and (b) preamble to SRO 499(1)/2009 dated 13/06/2009, further read with SRO 566(1)/2005 dated 6/6/2005.
