Dr Faisal Akhlaq challenges show cause notice issued by Sindh Revenue Board in SHC

KARACHI: Assistant Professor of Civil Hospital Dr Faisal Akhlaq Ali Khan approached the Sindh High Court (SHC) against the impugned notice issued by the Sindh Revenue Board (SRB).

A two-member bench comprising Justice Aqeel Ahmed Abbasi and Justice Rasheed Ahmed Soomro was hearing the petition. During the hearing, counsel for the petitioner requested time for preparation of arguments, therefore, the court granted his request and adjourned the hearing for November 22, 2016.

Earlier, counsel for the petitioner stated in his petition that he is a qualified plastic surgeon registered with Pakistan Medical and Dental Council and also running personal clinic. He further stated that officials of the SRB issued show cause notice dated October 06, 2016 which SRB claimed that his services are liable services 13 % effect from July 1, 2016.

According to the petitioner, notice further stated that however, it has been observed that you have neither got yourself registered/ richer e-enrolled with Sindh Revenue Board for Sindh Sales Tax on services nor deposited any SST amount since July 1, 2016.

Citing Secretary Revenue department Sindh, Chairman Sindh Revenue Board and deputy commissioner Sindh Revenue Board as respondents, petitioner pleaded the SHC may declare that Sindh Revenue Board has no authority to issue any notice for SST and may declare that act of the respondents is illegal, unlawful and of no legal effect.

Dr Faisal Akhlaq Ali Khan also pleaded that court may restrain them from taking any coercive action against him.
