FTO adjourns case of Colony Sugar Mills against RTO

LAHORE: The Federal Tax Ombudsman (FTO) has adjourned the hearing of a case filed by M/s Colony Sugar Mills Limited versus Regional Tax Office, (RTO) Lahore till next hearing.

Advisor to Federal Tax Ombudsman Tariq Yousaf heard the case of M/s Colony Sugar Mills in which the counsel for the appellant argued that the RTO Lahore has failed to make payment of tax refund claims to the company during the last three years.

He said that Lahore RTO collected excessive tax during the last three years but it did not pay the refunds claims despite many reminders.

The counsel for the appellant argued that at the end the appellant decided to approach FTO to interfere in this case and direct tax authorities to clear the refund claims as early as possible. The counsel further said that RTO should refund the excess collection at the end of year but it failed to do so.

On the other side, the RTO representative argued that the appellant M/s Colony Sugar Mills has not submitted all the record on the basis the company is submitting its claim for refunds. If appellant provides accurate record, the RTO will check the record and refund the extra tax to appellant, after assessment. He further said that the RTO has collected accurate tax according to the assessment.

After hearing the arguments from both sides the Adviser of FTO Tariq Yousaf adjourned the case till next date for further hearing and directed the parties to appear on said date for further hearing.
