IHC hears customs reference filed by M/s Wahaj Enterprises during 3rd week of Sep

ISLAMABAD: Islamabad High Court division bench comprising  Justice Shaukat Aziz Siddiqui and  Justice Mohsin Akhtar Kayani heard M/s Wahaj Enterprises customs case during third week of September.

The bench adjourned hearing of the matter. The appellant had filed the case against Customs Appellate Tribunal, Islamabad and Collectorate of Customs, Islamabad.

Barrister Masroor Shah, Muhammad Naeem Qazi, Raja Muhammad Tariq, Shan Zeb Khan, Sikandar Naeem Qazi had represented the appellant the case while Amin Feroze Khan, Naziran Malik, Muhammad Nawaz had contested on behalf of Customs Appellate Tribunal in the case.

It is pertinent to mention that the matter was filed with the court in 2008. The matter was pending with the court since then as the parties had been delaying hearing on the case.

Meanwhile, the court had issued plenty of notices and directions to conclude hearing on the matter. However, the parties caused delay in concluding the matter using delaying tactics.

Justice Athar Minallah and Justice Miangul Hassan connected M/S TNB Liberty Power Limited’s two tax matters with other income tax cases for further proceedings.

M/s TNB Liberty Power Limited had challenged recovery notices before the IHC through the said cases. LTU had issued the recovery notices in recent months in head of different taxes.

Through both the references, M/s TNB Liberty Power Limited had named Chief Commissioner Inland Revenue, LTU, Assistant Commission Inland Revenue Withholding, LTU, Commissioner Inland Revenue (Appeals), LTU, and Federal of Pakistan through the chairman of Federal Board of Revenue (FBR) as respondent in the case.

Show-cause notices had been issued for the tax year 2014 in head of income tax under sections of income tax ordinance, 2001.

M/s TNB Liberty Power Limited had prayed the court to direct LTU not to recover the said amount and abstain from any coercive action in this regard.

The petitioner had prayed the court operation of the impugned notices issued by the tax authority may kindly be suspended till the decisions of appeal pending before the LTU. Two benches of IHC had heard the different tax references filed by M/s TNB Liberty Power Limited.
