KARACHI: The Sindh High Court (SHC) dismissed the constitutional petition as not pressed filed by M/s PF Enterprises, seeking restoration of its license which was blocked by the Custom Department.
A two-member bench, comprising Justice Irfan Sadat Khan and Justice Muhammad Humayun Khan, was hearing the petition.
During the hearing, counsel for the petitioner informed the court that purpose for filing the instant petition has been served, hence, he does not press the same. The court dismissed the petition as not pressed.
Earlier, counsel for the petitioner stated in its constitutional petition that petitioner is clearing agent and filed goods declaration dated September 11, 2003 of the consignment of 14” TV cabinet with & remote control and after the all fulfil the formalities, same was release.
According to the petitioner, staff of the custom department issued demand notice amounting to Rs. 0.21 million against the importer i.e M/s Aamir Brothers Karachi and show cause notice also was served to the petitioner in which allegation was made out that petitioner was also involved in tax evasion.
Counsel for the petitioner further argued that without fulfilling the formalities, staff of the customs authorities dated April 23, 2014 was blocked illegally, mala fide and arbitrary.
Citing Collector of Customs Model Custom Collectorate of Appraisement West, the Deputy Collector of Customs Model Customs Collectorate of Appraisement West, the Assistant Collector of Customs (Recovery Officer) Port Muhammad Bin Qasim Karachi and Federal Revenue Division as respondents, petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and no legal effect and court may set aside impugn show cause notice.
Counsel for the petitioner also pleaded the Sindh High Court (SHC) may restrain the respondents from taking any action against the petitioner and de-block the licence of the petitioner which was blocked illegally.
