M/s CM Pak deposits evaded taxes in response to PCA audit observation

KARACHI: In response to the audit observation served by Customs Post Clearance Audit, M/s CM Pak has deposited short paid/evaded amount of duties and taxes.

As per details, during the audit of import data of ‘Lead Acid VRLA Batteries for Telephone Exchanges’ it has been observed that M/s. CM Pak Limited, imported ‘Lead Acid VRLA Battery for Telephone Exchange (48V)’, by mis-declaring them under PCT heading 8507.2010 chargeable to CD @ 10 % instead of declaring them under their correct PCT heading 8507.2090 chargeable to CD @ 20 %.

Thus, they have evaded/short paid and taxes to the tune of Rs. 311,547/- (Rs. 246,087/- under customs duty, Rs41,835/- under sales tax, Rs7383/- under additional sales tax and Rs16,242/- under income tax). It is pertinent to mention here that the similar goods have been cleared by different other importers under PCT heading 8507.2090 vide GD No. KPPI-HC-39931 dated 04.02.2015, KAPW-HC-137806 dated 07.03.2015, KAPW-HC-181122 dated 19.05.2015, KAPW-HC-37974 dated 26.09.2013 and KAPW-HC-55498 dated 16.10.2014.

The importer, in response to the audit observations, has deposited the amount of duty/taxes mentioned therein.
