M/s Qureshi Enterprises moves SHC seeking release of milk powder consignment

KARACHI: M/s Qureshi Enterprises filed a constitutional petition before the Sindh High Court (SHC) seeking consignment of coconut cream milk powder detained by customs officials due to non-printing of retail price and detail of ingredients in Urdu.

On August 31, 2019, counsel argued in his petition that his client has imported Satan Instant Coconut Cream Milk Powder which are also accompanying health certificate and certificate of authentication HALAL dated June 28, 2019 so as to comply the provision of SRO 237/2019, import policy order dated 2016.

He further argued that during the examination, customs officials made a report that “examination has pointed out discretionary relating to non-printing of retail price and detail of ingredients in Urdu” must to sorrow and regret the impugned goods were not being released nor the assessment in being finalized in the aforementioned goods declaration despite personal visits and written requests.

He said that petitioner is facing enormous hardship in the shape of demurrage and detention charges due to non-release of goods and non-finalization of assessment of goods declaration, therefore, petitioner is aggrieved and seriously prejudiced by the actions of the respondents, who being a government functionary and working, not allowing shifting of goods to CPF bond pending the final assessment of goods declaration under section 80 of the customs act, 1969.

Citing secretary Revenue Division, The Collector of Customs MCC Appraisement East as respondents, petitioner pleaded the court may declare that non allowing the shifting of goods to CPF bond is illegal, mala fide and unjustified in the eyes of law.

He further pleaded the court may direct the respondents to allow shifting of impugned goods to CPE Bond under the control of the respondents and grant any other relief deemed fit it the circumstances of the case.
