M/s TCS, Smarzone case: Customs Adjudication issues ONO in favour of Customs Intelligence

ISLAMABAD: Collector Customs Adjudication Dr Akhtar Hussain issued Order in Original (ONO) in favour of Customs Intelligence and Investigations and directed M/s TCS and Smartzone to deposit evaded amount of taxes and duties amounting to Rs 50,8,72,654 at the earliest.

Sources told Customs Today that after considering the contravention report submitted by Customs Intelligence and Investigation it was proved that M/s TCS, and Smartzone were involved in clearance of non-duty paid electronics goods worth Rs 8.7 million. The Customs Adjudication also imposed penalty of Rs 1,190 million on both companies.

Collector Adjudication Dr. Akhtar Hussain also declared that all electronics goods are liable to be seized according to section 156 (1) (8) (89) of Customs Act, 1969. Customs Adjudication acquitted TCS Regional Office Lahore Accounts Manager Zeeshan Ahmad Khan from all charges.

Collector Adjudication said that after examining all the electronics goods which are lying in Warehouse are non-duty paid as both companies failed to submit any relevant documents showing legal import of these goods. Sources said that some stickers which were displayed on cartons showed that these electronics goods are imported through transit trade via Karachi.

It is also necessary to mention here that Customs Adjudication also rejected the stance of M/s TCS CEO Saqib Abbas in which he stated that he signed all the relevant documents describing that all imported electronics goods are duty paid and they belonged to M/s Smartzone. According to ONO Chief Executive Officer M/s Smartzone Shakirullah Jan is also involved in import of non duty paid goods. Customs Adjudication also imposed penalty on TCS and Smartzone and their officials.
