PCA detects tax evasion of Rs8.66m by M/s Nazeer Marble Granite

KARACHI: The Directorate of Customs Post Clearance Audit detected duties and tax evasion of Rs8.66 million by M/s Nazeer Marble Granite, Karachi, it is learnt here.

Sources told Customs Today, that M/s Nazeer Marble Granite, located in M/s Pak Modern Colony imported a consignment of floor polish machines and its parts including rubbing brushes and got it cleared from the PICT Karachi vide GDs on January 8, 2018 by paying customs duty low at 10 percent after claiming the benefit of the SRO 566/2007.

However, the subject items are correctly classifiable under the PCT 2547.2504 attracting customs duty at 14 percent and income tax at 10 percent, thus, by way of mis-declaration of classification, the company evaded/short-paid Rs8.66 million. The goods were cleared by Appraiser Wasi Muhammad Shah.

Sources told that the importer violated the provisions of Section 55 (8-A) of the Customs Act-1969, Section 24  read with Section 69 of the Sales Tax Act-1990 and Section 47 of Income Tax Ordinance 2001 punishable under clauses (247) of Section 78(9) of the Customs Act-1969, Section 28 of the Sales Tax Act-1990 and Section 23 of Income Tax Ordinance 2001 and Section 9-A of the Sales Tax Act-1990 read with chapter X of the Sales Tax Special Procedure Rules 2007 (Special procedures for payment of sales tax by the importers) and under relevant provisions of Income Tax Ordinance 2001.

It is necessary to mention here that Post Clearance Audit will investigate 13 more cases in current month.
