Rawalpindi Customs impounds consignment with mis-declaration and tax evasion

ISLAMABAD: The Directorate, Customs Intelligence and Investigation (I&I), Rawalpindi, seized a consignment of mis-declaration and tax evasion amounting to Rs14.962million which was cleared by the AFU Islamabad.

The Directorate of I&I received a tip-off that an attempt would be made by M/s Hunbul Tex (Pvt) Ltd Lahore to evade duties and taxes by mis-declaring its description, value and PCT heading aimed at huge evasion. The total value assessed by the staff of the Customs RPAF Islamabad was Rs4.234million while the total assessed value of impounded goods as per VR No: 1237 was Rs30.426million. The total differential value found was Rs26.191million whereas duties and taxes paid was Rs0.769million against the actual taxes worth Rs14.962million.
The Goods Declaration (GD) No: 12374 dated 11.01.2018 filed by the above said company through M/s Capital Cargo Service (clearing agent CHAL No.191) for clearance of Digital Printing inks U/V assorted colors from AFU Islamabad was kept on electronic monitoring through WeBOC system.
After the clearance from the customs, the aforesaid GD was e-blocked at the gateout stage for further scrutiny. As per documents, goods were declared and assessed as reactive dyes and suggested PCT Heading -3204.1600 and assessed at 06 Euro per Kilogram attracting Customs Duty (CD) 16%, Sales Tax (St) 0%, Additional Customs Duty (ACD) 1% and obtained the benefit of SRO.1125(1)2011 dated 31.12.2011.
It was informed that the seized goods were reexamined in the presence of clearing agent namely Sajid Mehmood. The details mentioned on the recovered goods are as HUNBUL Textile reactive Dye LIQ containing 125 cartons of 4 cans of 10 Kilogram, total 500 cans (5000kg net). It is worth mentioning here that the plastic canes do not bear any name of manufactures while technical details of material, country of origin and as per knowledge, there is no plant in the name of HUNBUL preparing such state of artink in Europe. It means that the importer deliberately removed the original stickers to mis-declare description.
It was told that on 20-02-2018 a team consisting of Model Customs Collectorate (MCC) Islamabad staff carried out a physical survey. During the physical survey, they verified the manufacturing service providing facility and determined the business activity. The team of the MCC Islamabad recommended that this activity was confirmed by documents i.e. sales invoices, safety data sheet, factory pictures sensient reactive ink based on reactive dyes. Despite the cleared report given by the Customs Lab Lahore which also suggested that the PCT Heading 3215.9090 was of no need of second lab through HEJ Karachi. It shows malafide on the part of the staff of AFU MCC Islamabad.
The I&I Rawalpindi staff seized the the said tax case. The team comprises Director Abdul Waheed Marwat, Deputy Director Shahid Jan and other supporting staff of the I&I Rawalpindi.
