SHC bars tax authorities from recovering disputed amount from M/s Indigo Textile

KARACHI: The Sindh High Court (SHC) has restrained Tax Department from enforcing recovery of disputed amount from M/s Indigo Textile (Private) Limited.

The court ordered this on a constitutional petition filed by the company against a show cause notice issued by additional commissioner Inland Revenue Range-I RTO-II.

During the hearing of the petition, a two-member bench headed by Justice Aqeel Ahmed Abbasi also issued notices to the tax authorities and deputy attorney general and directed them to file their respective para wise comments on the next date of hearing.

Earlier, counsel for the petitioner stated that it is fulfilling all liabilities regularly, however, additional commissioner Inland Revenue Range-I RTO-II issued the notice under section 122 (5A) of the Income Tax Ordinance, 2001 dated 31/03/2017 for period of 01/07/2014 to 30/06/2015.

According to the petitioner, it filed an appeal before commissioner Inland Revenue Appeals-IV, which is pending for disposal, however, the Tax Department issued notice for recovery and attachment of the petitioner’s bank accounts illegally and without lawful authority.

Citing Secretary Ministry of Finance, chairman Federal Board of Revenue, Commissioner Inland Revenue Appeals-IV and additional commissioner Inland Revenue Range-I RTO-II as respondents, the counsel pleaded the court to restrain them from taking any coercive action against it till final order of the appellate authority.
