SHC directs customs authorities to file comments on petition filed by Irfan Changhani

KARACHI: A two-member bench of the Sindh High Court (SHC) headed by Justice Munib Akhtar has directed the customs authorities and deputy attorney general to file their respective para-wise comments on a constitutional petition filed by Irfan Changhani.

The petitioner sought release order for the consignment of paper and plastic printed waste, which was blocked by the Customs Department. During the hearing, Kashif Nazeer advocate filed power and sought time to file comments. Therefore, the court granted time and adjourned the petition date in office.

Earlier, counsel for the petitioner stated that petitioner purchased paper and plastic printed waste through supplier, Airlift (USA) Inc, on behalf of Al Shaab Waseem Metals Crap Truae and filed goods declaration according to the law.

According to the petitioner, after the fulfillment of all requirements, he approached the tax officials for release of its consignments. However, instead of releasing the consignment, the officials of the Custom Department blocked the same without showing any lawful reason.

Citing Secretary Ministry of Finance, chairman Federal Board of Revenue (FBR), collector of Customs Model Customs Collectorate, DG customs Intelligence as respondents, the petitioner pleaded the court to declare that act of the Customs Department as illegal, mala fide and arbitrary. He also pleaded the court to direct them to release the consignment immediately.
