SHC directs to issue delay detention certificate

KARACHI: The Sindh High Court (SHC) directed customs officials to release the consignment and delay detention certificate to be issued as per applicable rules and regulations on a petition filed by M/s Enercon International against imposition of regulatory duty on steel stand and wire, ropes, rods’ consignment.

A two-member bench, headed by Justice Aqeel Ahmed Abbasi, was hearing the matter of August 20, 2018.

During the hearing, counsel for the petitioner stated that it is engaged in the lawful business of import of steel stand and wire, ropes and rods and fulfills all the legal formalities according with law and never involved in any tax evasion matter.

He argued that petitioner imported a consignment of the above mentioned goods and filed goods declaration according with law, however, he was shocked when he was informed by the customs officials that said goods will be charge under regulatory duty.

Citing Secretary Revenue Division, Chairman Federal Board of Revenue, Collector of Customs Collectorate Appraisement West, Collector of Customs Collectorate East and Port Muhammad Bin Qasim and others as respondents, he pleaded the court to declare that act of the respondents as illegal, mala fide and arbitrary.

He submitted that court to declare that imposition of regulatory duty on said goods is illegal, set aside impugned order and restrain them from taking any action against the petitioner till final order in this petition.
