SHC directs to release consignment imported by M/s Arsalan Trading from China

KARACHI: A two-member bench of the Sindh High Court (SHC) directed customs officials to release the consignment of Enamelware tea pot/ kettle of assorted sized imported from China and compliance report may be furnished on next date of hearing on a constitutional petition fled M/s Arsalan Trading.

On 13 September 2021, a two-member bench, comprising Justice Shafi Muhammad Siddiqui and Justice Agha Faisal heard the matter.

After the hearing, court passed directions for customs officials and ordered that “request of the subject consignments shall be considered in accordance with law and compliance report may be furnished on next date of hearing.

Earlier, during the hearing, counsel for the petitioner argues that petitioner is lawful importer of above-mentioned goods and during the course of business, petitioner imported above mentioned goods and filed goods declaration and declared the value of US$ 1.18, however, petitioner was shocked when petitioner was informed that goods have been valuated at US$ 2.60 instead of US$ 1.18 which in unfair and totally against the law and no legal effect.

Citing chairman Federal Board of Revenue, Chief Collector of Customs Appraisement South, Collector of Customs Appraisement West, East and Port Muhammad Bin Qasim as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.

He further pleaded the court may direct the to release the above-mentioned goods and restrain them from taking any adverse action against the petitioner till final order in this petition.
