SHC directs to release consignment imported by M/s USM Bags after securing differential amount

KARACHI: The Sindh High Court (SHC) directed customs department to release imported consignment of luggage bags accessories (different raw material penal for luggage bags) after securing differential amounts on the shape of bank guarantee/ pay order on a constitutional petition filed by M/s USM Bags.

On 10 March 2022 a two-member bench, headed by Justice Irfan Sadat Khan heard the matter.

During the hearing, Gulam Haider Shaikh counsel for the petitioner argued that matter in on urgent basis, therefore, court may grant urgency.

After the hearing, court granted urgency and passed directions that “in view of the facts and circumstances of the case, we directed the customs authorities to release the goods imported by the petitioner subject to the condition with the petitioner will deposit undisputed amount within seven days and with regard to disputed amount postdated cheques with endorsement from the banker clearance for payment with the nazir with these directions this petition disposed of along with listed application”.

Earlier, counsel for the petitioner argued that petitioner has imported above mentioned goods and filed goods declaration according to law, however, goods are being assessed as per the impugned assessment alert valuation guideline dated Nov 22, 2021 which in unlawfully.

Citing Chairman Federal Board of Revenue, Director General of Valuation, Director Valuation, Collector of Customs Appraisement East as respondents, petitioner pleaded the court to declare act of the respondents as illegal, mala fide and arbitrary as well as may direct them to release petitioner’s imported goods as well as restrain them from taking any adverse action against the petitioner till final order in this petition.
