SHC directs to release consignments imported by of M/s Shahzeb Enterprises on bank guarantee

KARACHI: A two-member bench of the Sindh High Court (SHC) directed customs officials to release the imported consignment of petitioner after securing differential amount in the shape of bank guarantee/ pay order filed by M/s Shahzeb Enterprises

On 6 December 2021, during the hearing, Sardar Muhammad Ishaque advocate for petitioner, Kafeel Ahmed Abbasi deputy attorney general, Hussain Bohra assistant attorney general, Muhammad Rashid appeared before the court.

M Rashid advocate filed Vakalat Nama for customs department, counsel for the petitioner submits that although they have serious objections regarding of the invoice for the consignments, however, for the purpose of revised value of the consignments, they have ready to deposited differential amount between the invoice receipt and the goods declared.

After the hearing, court observed that “let such differential amounts in totality be secured with the commissioner concerned therefore the goods be released, the amount be made in terms of requirement of law after giving notice for the petitioner, petition stands disposed of in the above terms along with pending applications”.

Earlier, petitioner argues that petitioner is a commercial importer, exporter and wholesaler for welding machines, coolant liquid & gas regulators with gauge, cutting machine, welding torch with standard accessories cutting nozzle water cooler etc.

He added that during the course of business, petitioner imported above mentioned goods for UAE and filed goods declaration according to law, however, he was shocked when he was informed by the customs officials that valuation has been increased by the customs officials without lawful authority and issued demand notice further Rs. 31, 25, 953 without considering the facts.

Citing Chairman Federal Board of Revenue, Collector of Customs Appraisement East and others as respondents, petitioner pleaded the court may declare that act of the respondents is illegal, mala fide, direct them to release the same and restrain them from taking any adverse action against the petitioner till final order in this case.
