KARACHI: The Sindh High Court (SHC) has issued notices to tax authorities and deputy attorney general of Pakistan on a constitutional petition filed by Abdul Ghani, challenging valuation of polyester dyed fabric of lading suiting imported from India.
While hearing of the petition, a two-member bench, comprising Justice Munib Akhtar and Justice Anwar Husaain directed the tax authorities to file their para wise comments on the next date of hearing, September 27, 2016.
Earlier, counsel for the petitioner stated that he imported three consignments of polyester dyed fabric of lading suiting classifiable from India and filed goods declarations and also paid duty and taxes thereof in terms of his declarations dated July 29, 2016. The staff of Customs Appraisement-West carried out the assessment of the three consignments at the value of $7.00/kg in terms of Section 25 A (2) of the Customs Act, 1969.
He argued that, however, Customs Appraisement-West deputy collector had imposed “hold “against all the three consignments. The reason cited for such department action was that the value depicted in the valuation ruling was found to be lower than that declared at the stage of export and petitioner was informed that despite reassessment of the subject goods declarations’ $10.61/kg, 9.45/kg and 11.43/kg respectively.
Citing Revenue Division sectary, Customs Appraisement-West collector and deputy collector as respondents, the petitioner pleaded the SHC may declare the act of the respondents as illegal, mala fide and unlawful and court may declare that increased assessments of the above consignments are illegal, mala fide, unlawful, arbitrary.
