SHC issues notices to secretary finance & others on petition filed by M/s ITT Global Pvt Ltd

KARACHI: A two-member bench of the Sindh High Court (SHC) issued notices to the customs department and deputy attorney general of Pakistan directing them to file their respective para wise comments on a constitutional petition filed by M/s ITT Global Pvt Ltd (Dolman Mall & Dolman Real Estate Management Pvt Ltd)

On 29 December 2021, during the hearing, Ajeet Sundar advocate appeared on behalf of the petitioner and argued that it is substance a lease agreement for 11 months has been executed by the petitioner, however, petitioner to such agreement have not been arrayed as respondents.

Counsel added that it is the case of the petitioner that they have been issued an unlawful notice for recovery of stamp duty despite the fact that the subject agreement is only for 11 months and it is mutual consent of the parties that it could be executed hence no stamp duty is leviable.

Learned counsel submits that identical question is also included the CP 1313/2020 and others.

After the hearing, court issued notices to respondents and deputy attorney general for next date of hearing and directed office to connect this petition with others identical petitions.

Citing Chairman Secretary Finance, Member RS & EP, Chief Inspector of Stamps, Inspector of Stamps as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.

Counsel further pleaded the court may restrain them from taking any adverse action against the petitioner till final order in this petition.
