SHC seeks comments on petition challenging extra duty on hot rolled coils

KARACHI: The Sindh High Court (SHC) has directed customs officials to file their respective para wise comments on a constitutional petition filed by M/s Master Pipe Industries against fixation of extra duty on hot rolled coils, cold rolled and galvanized coils of secondary quality imported from European countries and Taiwan. A two-member bench was hearing the petition.

Earlier, counsel for the petitioner appeared before the court and submitted that the petitioner is engaged in the lawful business of import and fulfills all the responsibilities according with law. He regularly imports hot rolled coils, cold rolled and galvanized coils of secondary quality mostly from European countries and Taiwan.

The counsel argued that his client imported the above mentioned goods and filed Goods Declaration according to law, however, it is seriously aggrieved from act of the respondents who imposed extra duty on the same without lawful authorities and adopting legal manners.

After the hearing, court had issued notices to the customs officials and deputy attorney general and directing them to file comments on next date of hearing

Citing Chairman Federal Board of Revenue, Chief Collector of Customs Collectorate South, Collector of Customs Collectorate West, Collector of Customs Collectorate Port Muhammad Bin Qasim and Director General Valuation of Customs Valuation as respondents, petitioner pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary, he also pleaded the court to restrain them from taking any coercive action till final order in this petition. He further pleaded the court may restrain them from taking extra duty on its consignment.
