SHC seeks customs reply on petition filed by M/s Tracking World

KARACHI: The Sindh High Court (SHC) has sought comments from the FBR chairman, Collectorate of Customs Adjudication -I additional collector, Customs Intelligence director general and Deputy Attorney General on a constitutional petition filed by M/s Tracking World (Private) Limited seeking the release of its consignment.

A two-member bench, headed by Chief Justice Sajjad Ali Shah heard the petition.

Earlier, the petitioner’s counsel stated that petitioner imported a consignment of 831 pieces of GPS navigational system with accessories for radio navigational aid apparatus chargeable at 5 percent customs duty along with usual government taxes and filed goods declaration dated April 13, 2016; however, officials of the Customs Intelligence claimed that the remote control car, DVD player with HD navigation system chargeable at 35 percent customs duty and issued a show cause notice to the petitioner.

According to the petitioner, in reply, it submitted all the relevant documents and requested release of said consignment against submission of surety in shape of pay order / bank guarantee but respondents refused to entertain the same and to release the goods.

Petitioner pleaded the SHC may set aside impugned notice and restrain the respondents from taking any coercive action against the petitioner and court may direct the respondents to release the consignment.
