SHC to hear petition filed by M/s Etemad Trading on November 23

KARACHI: The Sindh High Court (SHC) has fixed November 23, 2016 as a date of hearing of a constitutional petition filed by M/s Etemad Trading, challenging a show cause notice issued by tax authorities, demanding extra tax on sales and supplies of tyre and tubes.

A two-member bench comprising Justice Aqeel Ahmed Abbasi and Justice Rasheed Ahmed Soomro was hearing the constitutional petition.

During the hearing, counsel for the petitioner stated that the respondents have issued show cause notice under section 11(2) & 9 (3) of the Sales Tax Act, 1990. The petitioner requested the court to consider it as an urgent application.

Earlier, counsel for the petitioner stated that petitioner imported a consignment of tyres and tubes against payment of sales tax @ 17% as well as value of additional 3% as final discharge of sales tax liability against those goods.

According to the petitioner, however, officials of the customs authorities issued notice to the petitioner, alleged that the petitioner has imported tyres and tubes which included in specified goods and no extra tax has been charged on sales/supplies of tyres and tubes.

Citing secretary Revenue division, DG Intelligence and Investigations Inland Revenue and the Assistant Director (Audit) Intelligence and Investigation-IR as respondents, petitioner pleaded that court may declare act of the respondents as illegal, unlawful and court may restrain them from taking any coercive action against the petitioner.
